And now recreational marijuana has been legalized statewide. The status of legal cannabis is constantly evolving, and there is a lot to keep up with as a cannabis consumer.\n\nIt's legal for certified patients In New York State to access cannabis for medical purposes. The legislation was first introduced in the summer of 2014, by [Governor Andrew Cuomo](https://en.wikipedia.org/wiki/Andrew_Cuomo). At that time, the [Compassionate Care Act](https://www.nysenate.gov/sites/default/files/patient_and_doctor_info._med._mar._program.pdf) allowed limited use of medical marijuana, including an initial ban on inhaled forms of consumption such as whole flower. \n\nIn late 2021, comprehensive changes were made to the bill removing smoking and increasing possession to a 60-day supply. More amendments were then made in early 2022, [expanding qualifying conditions](https://hellomd.com/articles/new-york-expands-condition-list-for-medical-marijuana-certifications) for medical marijuana patients and more.\n\nThe medical cannabis program in New York currently has over [120K patients registered](https://cannabis.ny.gov/medical-cannabis). This number is increasing which indicates that the population is consuming medical marijuana for various health conditions, as was intended by the initial legislation.\n\n### Recreational Cannabis Becomes Legal in New York\n\n![iStock-1190210123-min.jpg](https://hellomd-cms.s3.us-west-2.amazonaws.com/i_Stock_1190210123_min_edf589d9e9.jpg)\n\n[Recreational marijuana became legal](https://hellomd.com/articles/in-the-news-new-york-marijuana-legalization-2021) in March of 2021, for adult consumers in New York State. This legislation gives residents who are 21 years of age or older access to regulated cannabis through licensed dispensaries. But before the sale of adult-use recreational marijuana can begin, The [Office of Cannabis Management](https://cannabis.ny.gov/marihuana-regulation-and-taxation-act-mrta) (OCM) still needs to create the regulatory framework.\n\nThis means that there are currently no recreational dispensaries or storefronts open in New York to purchase adult-use cannabis. Recreational consumers will have to wait longer for the state to open legal stores - which could mean years. The only legal product available in the state currently is through the medical marijuana program for those who qualify.\n\nAccording to [Forbes](https://www.forbes.com/sites/chrisroberts/2021/08/27/he-didnt-like-cannabis-but-andrew-cuomo-was-big-marijuanas-best-friend/?sh=27b1db6350b4), one reason for the shift in policy is the states need for more tax revenue to assist with its economic recovery. This issue is very prevalent within the cannabis industry, as cannabis prohibition has resulted in the mass criminalization of average citizens. Cannabis legalization, including the consumption of recreational marijuana, has brought this issue into the limelight.\n\n[A lawsuit](https://law.justia.com/cases/federal/appellate-courts/ca2/18-859/18-859-2019-05-30.html#:~:text=Barr%2C%20No.-,18%2D859%20(2d%20Cir.,2019)&text=Plaintiffs%20challenged%20the%20district%20court's,failure%20to%20state%20a%20claim) is underway that challenges the [Controlled Substances Act](https://www.dea.gov/drug-information/csa) (CSA), regarding cannabis, deeming it to be unconstitutional.\n\nCitizens of New York state are currently still incarcerated for cannabis-related crimes, which is unjust under the circumstances. In addition, those with past cannabis criminal convictions are restricted from participating in the state's evolving cannabis industry. As a result, many minority groups are underrepresented in the industry and don't have the same opportunities. \n\nThe [MRTA](https://cannabis.ny.gov/system/files/documents/2021/09/cannabis-management-fact-sheet-9-21-social-equity-04_0.pdf) program does encourage social and economic equity with incentives for individuals disproportionally impacted by cannabis prohibition. While technically legalizing medical cannabis use no official regulations were ever put in place.\n\nIn 2013, Illinois passed its first medical cannabis law with teeth when Gov. Pat Quinn signed the [Compassionate Use of Medical Cannabis Pilot Program Act](http://www.ilga.gov/legislation/ilcs/ilcs3.asp?ActID=3503&ChapterID=35), legalizing the cultivation, sale, and use of medical marijuana in the state. Dispensaries started making their first sales to qualified patients in November 2015. \n\nWhen recreational weed was officially legalized in 2020, the landmark laws also triggered the expungement of hundreds of thousands of records of cannabis possession under 30 grams prior to legalization.\n\n### Who Can Buy Weed in Illinois Now?\n\nIf you're 21 or older and a legal resident of Illinois, [you can buy](https://hellomd.com/articles/what-are-the-weed-dispensary-rules-for-illinois) recreational cannabis from any of the adult-use dispensaries. You are allowed to buy up to 30 grams of weed (about half the amount a medical patient may purchase), five grams of concentrate, and edibles with up to 500 mg of THC. An Illinois visitor may possess up to half these amounts.\n\nIf you don’t want to or can’t go into a dispensary, many have online ordering and curbside pickup, so you don't have to wait in long lines. Check dispensary websites for regulations and policies. If you go to a dispensary, remember to bring your ID to prove you are 21 or older, and also bring cash, because credit cards are not currently accepted. \n\nAs far as medical cannabis in Illinois, registered patients and caregivers may purchase up to 2.5 ounces (71 grams) of usable cannabis per 14-day period from an authorized dispensary. The report’s focus was to examine the potential impacts of expanding the medical marijuana program into recreational marijuana in New York. Cuomo made it very clear he, himself, was NOT an advocate of cannabis, too-often touting the outdated good-old-boy ‘[gateway drug](https://www.politico.com/states/new-york/albany/story/2017/02/cuomo-says-he-remains-opposed-to-recreational-marijuana-109436)’\n argument against the plant. \n \nBut he could see the writing on the wall and was sweating peer-pressure from the encroachers: from the east — Massachusetts, where adult-use cannabis passed in 2016; Vermont, from the far side of the Adirondacks — an early-adopter of medical weed (2004), where\n possession and cultivation were decriminalized en route to full legalization (which would pass in 2020); and from the north, weed-loving Canada. Even New Jersey was on the fast-track to full legalization. The very thought of New Yorkers breaking the law to\n bring Jersey weed into New York must have been, well, unthinkable. \n \n### Easing Weed Restrictions in New York is Better for the Empire State\n\nThe [impact assessment](https://perma.cc/DV57-8UKK), completed seven months later, concluded that potential benefits of legal weed in the Empire State outweighed any potential negative impacts. Easing research restrictions would allow for further study of the plant’s efficacy, and of course, there was the shit-ton of potential tax revenue for the state. The report also concluded that legalizing marijuana would give New York an opportunity to address the glaring racial disparity in marijuana convictions and reduce “disproportionate criminalization and incarceration of certain racial and ethnic minority communities.” \n \nLocal jurisdictions created task forces to identify goals and challenges for full legalization. By the end of the year, NYC Mayor Bill DeBlasio’s task force [released recommendations](http://criminaljustice.cityofnewyork.us/wp-content/uploads/2018/12/A-Fair-Approach-to-Marijuana.pdf)\n for legal weed in the Big Apple, the primary focus of which was safety, health, and equity.\n \n### The New York Marijuana Regulation and Taxation Act\n\nIn 2019, adult-use legalization in New York stalled, but lawmakers passed a bill decriminalizing small amounts of marijuana and beginning the process of expunging previous convictions for cannabis possession. Finally, in March of 2021, as he was entering the fight against sexual misconduct allegations (that would end his tenure as governor), Cuomo signed the Legislature-passed Marijuana Regulation and Taxation Act, legalizing cannabis in the state of New York. \n \nImmediately, New Yorkers 21+ were allowed to:\n\n- smoke cannabis anywhere tobacco smoking is\n allowed (not near schools, at the workplace, or in a car), \n- legally carry up to three ounces of cannabis\n or 24 grams of concentrate, and \n- store up to five pounds of weed at home. \n \nMRTA also set forth the automatic expungement of prior convictions for anyone possessing less than one pound or selling less than 25 grams (0.88 ounces) of cannabis, an action that will bring the cannabis expungement numbers in New York up into the 300,000 range. In addition, New York’s cannabis program includes a [social and economic equity plan](https://www.thsh.com/uploads/NYLJ-Social-Equity-The-Driver-Behind-New-Yorks-Cannabis-Program.pdf), whereby 50% of business licenses will be prioritized for applicants from socially- and economically-disadvantaged groups.\n \n### Cannabis Consumption Lounges in New York\n\nMRTA, unlike the defeated Cuomo-backed Cannabis and Taxation Act (CRTA), also allows for consumption lounges. This was great news to organizers of New York’s underground weed party scene. Once they’re gone, new regulations limit edibles to a maximum tetrahydrocannabinol (THC) content of 100 milligrams.\r\n\r\nMeanwhile, staff at Revolution Emporium are still celebrating their latest win. Their award-winning candy company, Higher Confections, placed second in the edibles category at the 2017 Emerald Cup. \r\n\r\n“If Mendocino County makes a concerted effort, we’ll be the new Napa Valley. If we can grow and provide craft cannabis, people will come. We don’t have long lines like the Bay Area,” says Revolution Emporium partner Ian Hesz.\r\n\r\n“We’re not just a dispensary. Licensed dispensaries can provide recreational cannabis to adults 21 years of age and older with valid identification beginning Jan. 1, 2018. \n\nThe harsh reality is that [most cities aren’t ready for legalization](http://www.greenstate.com/explained/when-can-i-buy-legal-weed-in-california/). Many counties are still fleshing out their regulations and want all rules in place before permitting recreational sales. Why Does It Need a State License? \n\nStarting in January, all canna-businesses including dispensaries will be required to comply with complex regulations addressing how medicine is grown, produced, tested, transported and packaged. These are important considerations for everyone, but especially for medical marijuana patients who depend on clean, tested medicine to maintain optimum health. Lawmakers hope a regulated cannabis industry will improve the quality, consistency and safety of cannabis products.  \n\n### How Do I Know if My Dispensary Is Licensed? \n\nThe BCC is posting a regularly updated [list of licensed marijuana businesses](https://aca5.accela.com/bcc/Cap/CapHome.aspx?module=Licenses&ShowMyPermitList=N). You can search by street name and city, or to view all licenses, try searching dates between Dec. 15, 2017 and Jan. 2, 2018.\n\nCheck the [cannabis laws in your city](http://projects.sfchronicle.com/2017/embed-pot-lookup/) to keep abreast with what’s happening in your neighborhood. Be patient as your dispensary adjusts to—as a means of complying with—the many new rules that are going into effect as of Jan. 1.\n\n### Why Remain a Medical Marijuana Patient When Recreational Cannabis Becomes Legal? \n\nFor over 20 years, [Proposition 215 has allowed medical marijuana patients to purchase and possess as much cannabis as you need](http://www.canorml.org/news/what_will_be_legal_and_what_wont_after_Prop_64) for your medical use. Those statutes don’t change with the enactment of Proposition 64. \n\nThe rules for recreational users, however, are much stricter. Proposition 64 limits recreational users to obtaining, transporting or giving away no more than 1 ounce of marijuana or 8 grams of concentrated cannabis. This is another reason to keep your medical marijuana recommendation or obtain one before the end of the year.\n\nIf you’re between 18 and 20 years of age, you won’t be allowed to purchase recreational cannabis until you’re 21. If you’re under 21 and already have a recommendation, you’ll be able to purchase medical cannabis on and after Jan. 1, even if recreational users can’t.\n\n### Is Anything Changing With Marijuana Edibles? \n\nYes. Parents and youth advocates were concerned that some cannabis edibles looked too much like candy and not enough like medicine. Others felt some products contained excessively high levels of tetrahydrocannabinol (THC), posing risks to the public. Proposition 64 addressed these concerns by creating new standards for edibles.\n\nIn January, say farewell to those “medibles” shaped like animals or cartoon characters. They’ll probably reappear, redesigned in a different shape and sold in distinctly different, “child-unfriendly” packaging. \n\nServing sizes are changing dramatically, with all edibles capped at 100 milligrams of THC per package. Items like [chocolate bars must be scored into 10-milligram-sized serving pieces](http://www.mercurynews.com/2017/11/17/californias-new-cannabis-rules-no-drone-deliveries-or-pot-laced-shrimp/), and products must be blended in such a way that THC and other cannabinoids are mixed equally throughout the product.\n\nDispensaries will have a grace period during which they can offer the last of their pre-2018 inventory to patients. In 2018, certain items specifically produced for patients, such as tinctures, may contain a higher THC content. Those will only be available to patients. If there’s a product you know will be sun-setting in January due to these changes, now’s the time to stock up. \n\n### Brace Yourselves. The Price of Cannabis Is Going Up—Way Up for Rec Consumers \n\nLet’s face it, one reason Proposition 64 passed was because lawmakers were eager for the tax revenues generated from the multibillion-dollar cannabis industry. For example, cultivators must now pay the state a tax of $9.25 per ounce of cannabis flowers and $2.75 per ounce of cannabis leaves—just two of the regulatory costs soon to be passed on to consumers.\n\nIn January, cannabis consumers will pay a 15% state excise tax to retailers, in addition to hefty local taxes. _Fortune Magazine_ estimates that in some communities, recreational users could see as much as a [70% increase in cannabis prices](http://fortune.com/2017/11/06/california-marijuana-tax/) come January. The _LA Times_ notes that a $35 purchase of quality cannabis flowers could jump to as much as $70, leaving patients suffering from sticker shock in advance of legalization.\n\n### I’m All for Taxing Cannabis, but Is There a Way to Reduce My Expenses? \n\nYes. [Your city’s sales and use taxes will be waived](http://www.cdtfa.ca.gov/news/17-28.htm) at your dispensary if you possess a Medical Marijuana Identification Card (MMIC) issued by the California Department of Public Health. \n\nThe sales and use tax waiver applies to retail sales of medicinal cannabis products, which includes flowers, concentrates, edibles and topicals. \n\n### Is This MMIC the Same as My Doctor’s Recommendation? \n\nNo. The MMIC is issued by the California Department of Public Health. The MMIC is obtained only at your County Public Health Department—not through your doctor or evaluation center. \n\nThere’s a fee for the MMIC, but Proposition 64 requires that counties cap fees for the MMIC at $100. Discounts are available for qualifying low-income patients. If you rely on more than a few grams of flowers per year, investing in the MMIC will bring immediate cost savings and bolster your legal standing as a medical marijuana patient. A current doctor’s recommendation is required to qualify for the MMIC—another reason to keep or obtain your cannabis recommendation.\n\nIt’s important to note that an MMIC isn’t required to purchase medical marijuana at a dispensary.\n\nVisit the California Health Department’s [MMIC FAQ page](https://www.cdph.ca.gov/Programs/CHSI/Pages/MMP-FAQS.aspx?PagePreview=true) for more information. Medicinal cannabis has been available in Nevada, but the state also passed a measure for the implementation of a recreational market, which opened up in the state on July 1st of 2017. Poor planning and tight restrictions, however, have led the recreational market to overwhelm the limited infrastructure that was put in place, severely limiting access to legal cannabis. In short, Nevada ran out of cannabis.\r\n\r\nFOLLOW US ON [FACEBOOK](https://www.facebook.com/pg/hellomdcompany/posts/) & [INSTAGRAM](https://www.instagram.com/hellomd_com/?hl=en)\r\n\r\nNevada was the fifth state to open a recreational cannabis market and their laws stipulate that adults over the age of 21 can buy and possess up to an ounce of cannabis flower or 1/8 ounce of concentrated cannabis products. Recreational cannabis consumers have flooded Nevada’s limited marketplace, leading to a doubling in prices. Las Vegas dispensaries alone have seen a 1000% increase in sales since the recreational market opened in the state. In addition, under the new system the cost of cannabis has become prohibitive for many consumers, leading them to seek out their medication on the black market. \r\n\r\n### Cannabis is Not the Alcohol Industry\r\n\r\nSo why did Nevada run out of cannabis? The Nevada system has been set up to mimic the alcohol industry forcing retailers to use distributors from the liquor industry. Distributors are required to get specific licenses in order to distribute cannabis, and at the time of recreational legalization there were not enough distributors for the amount of retailers to meet consumer demand. This meant that when the recreational market opened up, most cannabis dispensaries were only able to sell the products they currently had in stock, leading to limited supplies and higher prices.\r\n\r\nState officials have taken action against this shortage in cannabis products by quickly coming together to change existing regulations. The shortage forces the issue of people returning to the black market in order to access cannabis at all, as well as at a lower price. The prospect of consumers being forced to go to illegal sources leaves them at risk for receiving contaminated cannabis products as well as leaving tax dollars on the table, which politicians do not want.\r\n\r\n### 'Statement of Emergency' \r\n\r\nGovernor Brian Sandoval  issued a ‘statement of emergency’ (different from a state of emergency), in order to change regulations with the intent to help increase the amount of cannabis going to the 47 retail locations around the state. It has also led to the issue of two new distribution licenses in order to help increase the amount of cannabis going into dispensaries. \r\n\r\nThere is also a consideration in the state to expedite even more licenses for distribution in order to meet the public's demand. The state must also consider that a large amount of the excess demand is caused by tourism in the state. 63% of recreational sales in Nevada are expected to be from tourists, particularly in Las Vegas. \r\n\r\nOne of the largest issues facing the state now is how to get more cannabis into the marketplace, which is greatly limited by the inability to bring cannabis in from other states. Since cannabis is still nationally illegal, cannabis can not be imported from states like California, which has very favorable growing conditions for cannabis with a large potential to export cannabis if legally allowed. National restrictions, however prevent cannabis from crossing borders, even between two states who have legalized the product. Cannabis got favorable marks in this new survey; 67% of people surveyed perceived opioids to be riskier than cannabis, 76% of people indicated they believed marijuana to be less dangerous than tobacco and 70% thinking cannabis is less risky then alcohol. Also, 83% of people surveyed believed that cannabis should be medically legal nationwide.\n\n55 million Americans use medical marijuana, which is not surprising considering the new trend towards acceptance. Recreational marijuana, however, got mixed reviews in the recent survey. Only 49% of people believed that recreational marijuana should be legalized, just 2% more than the amount of people who were opposed to it. That was in association with 4% of people who were not certain about whether they believe it should be recreationally legal or not. People who tried cannabis, however, were more accepting of recreational legalization with 70% of those being in favor, as compared to 26% of people who have never tried marijuana. \n\nFOLLOW US ON [FACEBOOK](https://www.facebook.com/pg/hellomdcompany/posts/) & [INSTAGRAM](https://www.instagram.com/hellomd_com/?hl=en)\n\n\n### Less Stigma?\n\nCannabis, is also becoming more socially acceptable. 56% of people surveyed believe that cannabis consumption is socially acceptable, even though 51% of people do believe cannabis consumption is a health risk. 52% of consumers are millennials, showing a clear distinction between generations. Millennials, interestingly, were also the most conflicted generation about their cannabis use. 25% of millennials felt guilty about cannabis use, compared to just 17% of non-millennials. \n\nParents are also a growing group of cannabis consumers. 54% of adult cannabis consumers are parents, the majority with children under the age of 18. Nearly all parents surveyed, however, will not consume cannabis while in the company of their children. There is also a clear distinction between political parties when it comes to cannabis consumption. Only 14% of cannabis consumers are Republicans, showing the great majority to be Democrats or Independents. \n\n### Medical Marijuana More Accepted\n\nWhat is clear from the survey is that medical marijuana consumption is considered more mainstream than recreational consumption. Most consumers who were surveyed consume cannabis for medical reasons, with only 16% saying they used cannabis “just for fun”. Far more consumers use cannabis to help with pain, to assist with relaxation, or to make them more comfortable in social situations. \n\nThe study by Yahoo and Marist is just one indicator that cannabis has gone mainstream. Congressmen agreed with the findings of the study and have recently started a Congressional Cannabis Caucus to approach the issue in the coming years.
